1. Acceptance of Terms

These Terms and Conditions govern your use of Wanthong's senior care services and website. By enrolling in our programs, visiting our facilities, or using our website, you agree to be bound by these terms.

2. Definitions

  • "Wanthong," "we," "us," "our" refers to Wanthong senior care services
  • "Resident" refers to any individual enrolled in our care programs
  • "Family Member" or "Representative" refers to authorized family members or legal representatives
  • "Services" refers to all care programs, activities, and support provided by Wanthong
  • "Agreement" refers to these Terms and Conditions and any service-specific contracts

3. Eligibility and Enrollment

To enroll in Wanthong's services:

  • Residents must be 60 years of age or older
  • The resident or their legal representative must have the capacity to enter into this agreement
  • All required documentation must be completed and submitted
  • An initial assessment must be completed to determine appropriate program placement

Wanthong reserves the right to decline enrollment if we determine that our services do not adequately match the individual's needs or if our community would not be in the person's best interest.

4. Service Description

Wanthong provides three distinct care programs:

4.1 Afternoon Tea Social Program

A five-day-a-week afternoon program including tea gatherings, social activities, and transportation assistance. This is a non-residential program for individuals living independently.

4.2 Communal Home Residency

Residential care in a home-scaled community including accommodation, meals, housekeeping, personal care assistance, and daily activities. Residents live in private or shared rooms within a community of 12-16 individuals.

4.3 Private Garden Residence

Private suite accommodation with personal garden access, individually prepared meals, dedicated personal aide, and customized care plan. This represents our most comprehensive level of personalized service.

Important Note: Wanthong provides supportive care and assistance with daily living. We are not a medical facility and do not provide nursing care or medical treatment. Residents requiring ongoing medical care must coordinate with their own healthcare providers.

5. Fees and Payment Terms

5.1 Program Fees

Monthly fees are as follows:

  • Afternoon Tea Social Program: ฿8,500 per month
  • Communal Home Residency: ฿29,500 per month
  • Private Garden Residence: ฿59,000 per month

5.2 Payment Terms

  • Fees are due on the first day of each month
  • Payment may be made by bank transfer or check
  • A grace period of 10 days is allowed before late fees apply
  • Late payment may result in service suspension

5.3 Fee Adjustments

Fees may be adjusted annually with 60 days advance written notice. Adjustments will reflect changes in operational costs and maintain service quality.

5.4 What's Included

Monthly fees include all services described in the program documentation. There are no hidden fees or additional charges unless mutually agreed upon in writing.

6. Resident Rights and Responsibilities

6.1 Resident Rights

All residents have the right to:

  • Be treated with dignity and respect
  • Privacy in personal matters
  • Participate in decisions about their care and daily routines
  • Receive visitors without restriction
  • Voice concerns or complaints without fear of retaliation
  • Access their own records

6.2 Resident Responsibilities

Residents and their representatives are expected to:

  • Treat staff and other residents with respect
  • Provide accurate health and personal information
  • Communicate changes in health status or care needs
  • Make timely payment of fees
  • Respect the community environment and other residents' comfort

7. Termination of Services

7.1 Voluntary Termination by Resident

Residents may discontinue services at any time with 30 days written notice. Fees are prorated for partial months of service.

7.2 Termination by Wanthong

We may terminate services under the following circumstances:

  • Non-payment of fees beyond the grace period
  • The resident's needs exceed our care capabilities
  • Behavior that poses a risk to staff or other residents
  • Material breach of these terms

Except in cases of immediate safety concerns, we will provide 30 days notice and work with families to arrange appropriate alternative care.

8. Health and Safety

Wanthong maintains safety protocols and emergency procedures. However:

  • We cannot guarantee prevention of all accidents or health incidents
  • Residents are encouraged to maintain relationships with their healthcare providers
  • In medical emergencies, we will contact emergency services and notify designated family members
  • Residents requiring specialized medical care must arrange this independently

9. Limitation of Liability

To the fullest extent permitted by Thai law:

  • Wanthong's liability is limited to direct damages arising from our negligence
  • We are not liable for indirect, consequential, or incidental damages
  • We are not responsible for personal property loss or damage unless due to our gross negligence
  • Maximum liability does not exceed six months of program fees

Nothing in these terms limits liability for death or personal injury caused by our negligence.

10. Privacy and Confidentiality

We handle personal and health information in accordance with our Privacy Policy and Thai data protection laws. All staff are bound by confidentiality obligations.

11. Intellectual Property

All content on our website, including text, graphics, logos, and images, is the property of Wanthong or our licensors. You may not reproduce, distribute, or create derivative works without our written permission.

12. Governing Law and Jurisdiction

These Terms and Conditions are governed by the laws of Thailand. Any disputes arising from these terms or our services shall be subject to the exclusive jurisdiction of the courts of Chiang Mai Province, Thailand.

13. Dispute Resolution

Before initiating legal proceedings, parties agree to attempt to resolve disputes through good faith negotiation. If resolution cannot be reached within 30 days, either party may pursue formal legal remedies.

14. Severability

If any provision of these terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

15. Changes to Terms

We may update these Terms and Conditions periodically. Significant changes will be communicated to residents and families with 30 days notice. Continued use of our services after changes take effect constitutes acceptance of the updated terms.
